Eswatini Football Games

1. Introduction and Acceptance

These Terms and Conditions ("Terms") form a binding agreement between you ("User", "you", "your") and Invertedapps ("Company", "we", "us", "our"), the company that owns and operates Eswatini Football Games ("EFG"), including the EFG mobile application and any associated website, features, and services (together, the "Services").

Invertedapps operates from Mbabane, Kingdom of Eswatini. Eswatini Football Games (EFG) is a mobile application and digital platform owned and operated by Invertedapps.

By downloading, installing, accessing, or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, you must not use the Services.

We may update these Terms from time to time. Material changes will be communicated as described in Section 21 (Notices) and reflected by an updated "Effective Date" above. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

2. Definitions

For the purposes of these Terms, the following words have the meanings set out below. Other capitalised terms are defined where they first appear.

"App" means the EFG mobile application, available for supported devices, together with any updates, patches, or new versions of it.

"Content" means all text, data, graphics, logos, crests, images, statistics, fixtures, results, standings, and other material made available through the Services, whether produced by Invertedapps or by a third party.

"Contributions" means any comments, ratings, predictions, or other material that you submit, post, or upload through the Services, as described in Section 8.

"EFG" or "Eswatini Football Games" means the mobile application, brand, and digital football platform owned and operated by Invertedapps.

"Services" means the App and any associated website, features, notifications, and related services operated by Invertedapps, as described in Section 1.

"Rights Holder" means any person or organisation that owns or controls intellectual property that appears within the Services, including club badges, competition names, sponsor marks, and league data.

"User", "you", "your" means any person who downloads, installs, accesses, or otherwise uses the Services.

"Invertedapps", "we", "us", "our" means the company that owns and operates EFG and the Services, as described in Section 1.

4. Eligibility

The Services are intended for users aged 13 and older. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Services you represent that you have the legal capacity to enter into this agreement and that your use will comply with all applicable laws in Eswatini and any jurisdiction from which you access the Services.

We do not knowingly collect information from, or verify the age of, individual users, and have no reliable means of confirming a user's age. We therefore rely on parents and legal guardians to supervise and monitor their children's use of the Services. If you believe a child under 13 is using the Services without appropriate supervision, please contact us using the details in Section 23.

5. Your License to Use the App

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to download and use the EFG app on devices you own or control, for your personal, non-commercial use.

The App requires Android version 7.0 (Nougat) or later. We do not guarantee that the App will function correctly, or at all, on devices running an earlier version of Android, on unsupported devices, or on devices that have been modified (for example, rooted) in a manner that affects normal operation.

You must not:

• Copy, modify, reverse-engineer, decompile, or create derivative works based on the app, except to the extent expressly permitted by applicable law;
• Rent, lease, sublicense, sell, resell, or commercially exploit the app or its content;
• Use automated means (bots, scrapers, crawlers) to extract data, fixtures, results, or statistics from the Services without our prior written consent;
• Remove or obscure any copyright, trademark, or attribution notices;
• Use the Services to build a competing product or service;
• Circumvent any security, access, or rate-limiting measures we put in place.

We reserve the right to suspend or terminate your access if we reasonably believe you have breached this licence.

6. Accounts (Where Applicable)

If any part of the Services requires you to create an account, you agree to provide accurate information, keep your login credentials confidential, and notify us promptly of any unauthorised use of your account. You are responsible for all activity that occurs under your account.

7. Acceptable Use

You agree not to use the Services to:

• Post or transmit content that is unlawful, defamatory, harassing, hateful, obscene, or discriminatory;
• Impersonate any person, club, competition, or organisation;
• Upload viruses, malware, or any code intended to disrupt or damage the Services;
• Interfere with the proper functioning of the Services or the servers and networks connected to it;
• Submit false match reports, scores, or statistics intended to mislead other users;
• Violate the intellectual property, privacy, or other rights of any third party.

We reserve the right, but not the obligation, to monitor use of the Services, remove content, and suspend or terminate accounts that violate this section, at our reasonable discretion and, where practicable, with notice.

8. User Contributions

If the Services allow you to submit comments, ratings, predictions, or other Contributions, you retain ownership of your Contributions. By submitting a Contribution, you grant us a worldwide, royalty-free, non-exclusive licence to host, display, reproduce, and distribute that Contribution within the Services. You are solely responsible for your Contributions and warrant that they do not infringe the rights of any third party or violate Section 7 (Acceptable Use).

We may, at our discretion, remove any Contribution without notice if we consider it to breach these Terms.

Responsibility for User Content

Users remain solely responsible for any comments, predictions, ratings, discussions, images, videos, or other content they submit through the Services.

Users represent and warrant that they possess all necessary rights to submit such content and that their submissions do not infringe any intellectual property, privacy, publicity, or other legal rights of any third party.

Users agree to indemnify and hold Invertedapps harmless from any claim, demand, loss, liability, damage, or expense arising from content submitted by the user.

9. Intellectual Property

9.1 Intellectual Property

The EFG name, logo, app design, source code, database structure, and original written content are the intellectual property of Invertedapps and are protected under the copyright and intellectual property laws of Eswatini and applicable international treaties. Nothing in these Terms transfers ownership of that intellectual property to you or to any third party we partner with, except under a separate written agreement that expressly says so.

9.2 Third-Party Marks and Data

Club badges, competition names, sponsor marks, and similar third-party intellectual property that may appear in the Services remain the property of their respective owners and are used for identification purposes under fair use, editorial, or informational principles. If you are a rights holder and have concerns about how your marks are used, please see Section 10 (DMCA / Intellectual Property Takedown Procedure) or contact us using the details in Section 23.

9.3 Data Accuracy Disclaimer

Fixtures, results, standings, and statistics are compiled from publicly available sources and, where applicable, official league data. While we take reasonable care to keep this information accurate and current, we do not guarantee that all data is complete, error-free, or updated in real time, and you should verify time-sensitive information (such as match kick-off times) through official league or club channels.

9.4 Feedback and Submissions

If you send us any feedback, suggestions, bug reports, or ideas for improving the Services ("Feedback"), you agree that Invertedapps may use, modify, and incorporate that Feedback into the Services for any purpose, commercial or otherwise, without any obligation, attribution, or compensation to you. You retain no ownership claim over how we choose to act on Feedback you provide.

9.5 Football Data and Statistics

Through EFG, we provide football-related information, including fixtures, results, standings, statistics, player information, transfer news, and match-related content for informational and entertainment purposes only.

While we take reasonable steps to maintain accurate information, we do not warrant or guarantee the completeness, accuracy, reliability, timeliness, or availability of any football-related data. Information may be delayed, incomplete, corrected, or changed without notice.

Users should independently verify important information through official club, league, federation, or competition sources before relying upon it for any purpose.

9.6 Rights Holder Cooperation

We respect the intellectual property and commercial rights of football clubs, leagues, sponsors, broadcasters, federations, and other rights holders.

Where a rights holder reasonably believes that content appearing within the Services infringes or improperly uses its rights, we may review, modify, restrict, remove, or replace such content at our sole discretion and without prior notice to users.

Nothing in the Services shall be interpreted as granting any user a right to reproduce, distribute, exploit, or commercialise any third-party intellectual property appearing within the Services.

10. DMCA / Intellectual Property Takedown Procedure

We respect the intellectual property rights of others and expect users to do the same. If you are a Rights Holder and believe that Content available through the Services infringes your copyright, trademark, or other intellectual property rights, you may submit a takedown notice to us using the contact details in Section 23.

To help us act on your notice promptly, please include:

• Identification of the specific work or mark you claim has been infringed;
• Identification of the material you claim is infringing, with enough detail (such as a screenshot or in-app location) for us to locate it within the Services;
• Your name, organisation (if applicable), and contact details;
• A statement that you have a good-faith belief that the use of the material is not authorised by the rights holder, its agent, or the law;
• A statement, made under penalty of perjury or its local equivalent, that the information in your notice is accurate and that you are the rights holder or authorised to act on the rights holder's behalf;
• Your physical or electronic signature.

On receipt of a valid notice, we will review the claim and, where appropriate, remove or disable access to the identified material within a reasonable time. We may notify the user who submitted the material, where applicable, and give them an opportunity to respond before reinstating any material removed in error.

If you believe material was removed as a result of a mistaken or bad-faith claim, you may submit a counter-notice to the same contact details, explaining why the material does not infringe. We reserve the right to make the final determination as to whether to remove, restore, or retain any Content, and to terminate the access of users who are found to be repeat infringers.

11. Advertising and Monetisation

The Services may display advertising, sponsor placements, or promotional content, including from the EFG app's own sponsors. Any monetisation arrangement between Invertedapps and a third party (such as a sponsor or league partner) does not create any obligation between you and that third party, and Invertedapps is not responsible for the content, products, or services of third-party advertisers.

Additional Products and Commercial Services

We may introduce additional products, premium features, subscriptions, merchandise, ticketing services, fantasy competitions, promotions, or other commercial offerings through EFG from time to time.

Such offerings may be governed by additional terms, conditions, pricing policies, refund policies, or promotional rules. By participating in or purchasing any such offering, users agree to comply with any applicable supplementary terms presented at the time of purchase or participation.

We reserve the right to modify, suspend, or discontinue any commercial offering at any time.

12. Not for Betting or Wagering Purposes

The Services are provided strictly for informational and entertainment purposes. Fixtures, results, standings, statistics, and any predictions or analysis available through the Services are not intended to be used, and must not be relied upon, as a basis for betting, wagering, gambling, or any similar activity, whether or not conducted through a licensed operator.

We accept no responsibility or liability for any loss, financial or otherwise, arising from betting or wagering decisions made in reliance on data or content obtained through the Services. If you choose to engage in betting or gambling activity, you do so entirely at your own risk and in accordance with applicable law and the terms of the relevant licensed operator.

13. Third-Party Links and Content

The Services may contain links to third-party websites (for example, club or league websites, ticketing platforms, or news sources). These links are provided for convenience only. We do not review, control, or endorse third-party content and are not responsible for it. Accessing a third-party site is at your own risk and subject to that site's own terms.

14. Availability and Changes to the Services

We aim to keep the Services available and up to date, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any feature of the Services at any time, including for maintenance, updates, or reasons beyond our control, without liability to you for reasonable interruptions.

15. Force Majeure

We will not be liable for any failure or delay in performing our obligations under these Terms, or for any unavailability or malfunction of the Services, where that failure, delay, unavailability, or malfunction results from causes beyond our reasonable control. Such causes include, without limitation:

• Natural disasters, extreme weather, fire, or flood;
• Power outages, internet or telecommunications network failures, or failures of third-party hosting, cloud, or infrastructure providers;
• Acts of government, changes in law, or other regulatory action;
• War, civil unrest, terrorism, or public health emergencies;
• Labour disputes, strikes, or the unavailability of key personnel or suppliers;
• Cyberattacks, denial-of-service attacks, or other malicious third-party interference with the Services.

Where such an event occurs, our obligations under these Terms will be suspended for the duration of the event, and we will take reasonable steps to resume normal operation of the Services once the event has ended.

16. Disclaimer of Warranties

To the fullest extent permitted by the laws of Eswatini, the Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Your use of the Services is at your own risk.

17. Limitation of Liability

To the fullest extent permitted by law, Invertedapps and its directors, officers, and any future employees or contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or goodwill, arising from your use of, or inability to use, the Services, even if advised of the possibility of such damages. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under the laws of Eswatini.

18. Indemnification

You agree to indemnify and hold Invertedapps harmless from any claim, loss, liability, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Services, or your violation of any third party's rights.

19. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law, or for legitimate operational reasons. You may stop using the Services and delete the app at any time. Sections that by their nature should survive termination (including Sections 9, 16, 17, and 18) will continue to apply.

20. Notices

We will provide notice of material changes to these Terms, and any other legal or operational notices affecting your use of the Services, through one or more of the following channels:

• A push notification sent to the App (where you have notifications enabled);
• An email sent to the address associated with your account (where applicable);
• An in-app banner, message, or update to the Effective Date shown at the top of these Terms.

It is your responsibility to keep any contact details you provide to us up to date and to review notices when you receive them. Notices are considered received when sent, posted, or displayed, regardless of whether you open or read them.

21. Privacy

Our collection and use of personal information is described in our Privacy Policy, available at https://invertedapps.com/privacy.html.

By using the Services, you consent to that collection and use as described there.

22. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Kingdom of Eswatini, without regard to conflict-of-law principles. You agree that the courts of Eswatini shall have exclusive jurisdiction over any dispute arising from or relating to these Terms or the Services, except where mandatory local consumer-protection law in your country of residence provides otherwise.

Before initiating formal proceedings, both parties agree to attempt in good faith to resolve any dispute informally by contacting Invertedapps using the details in Section 23.

24. General Provisions

Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Invertedapps regarding the Services.

Severability: If any provision is found unenforceable, the remaining provisions remain in full force and effect.

No Waiver: Our failure to enforce any right or provision is not a waiver of that right.

Assignment: We may assign these Terms in connection with a merger, acquisition, or sale of assets, or as part of formalising a partnership such as with PLE; you may not assign your rights under these Terms without our consent.

No Partnership: Nothing in these Terms creates a partnership, joint venture, or agency relationship between you and Invertedapps.
